How Much Do Real Estate Lawyer Fees Cost When Selling a House in Ontario?

Real estate lawyer fees when selling a house in Ontario usually run between $800 and $1,500 plus HST for the legal work itself, with disbursements adding roughly $200 to $400 on top. Most sellers finish with a total legal bill somewhere near $1,200 to $2,000 once tax is counted.

Sale files cost less than purchase files, and the reason is how much searching each one takes. A buyer's lawyer has to investigate title, check for writs, review a status certificate on a condo, register a new mortgage and correspond with a lender. Selling asks for less. Your lawyer reviews the agreement of purchase and sale, prepares the transfer, arranges the payout of any mortgage registered against the property, moves the money on closing day and reports to you afterward. That narrower scope is why sale quotes at Toronto firms often start near $999 plus HST, and it helps to know what a real estate lawyer actually does in Ontario before you compare prices.

What the disbursements cover

Disbursements are out-of-pocket amounts your lawyer pays on your behalf and passes through to you. Registering a discharge of mortgage electronically through Ontario's land registration system costs $86.42 as of November 2026. There is a fixed LawPRO transaction levy on every real estate file. Beyond that you are paying for conveyancing software, couriers, bank drafts and wire charges. None of it is profit for the firm, which is why these amounts appear as their own lines on your final statement instead of being folded into the quoted fee.

One charge surprises sellers regularly, and it is not a legal fee at all. Where a mortgage is still registered on the property, the lender adds its own discharge administration fee, commonly $260 to $340 at the big banks. Ending a fixed term early can also trigger a prepayment penalty large enough to dwarf every other closing cost. Your lawyer is also the person who works out what you actually walk away with. Prepaid property taxes, utilities and the deposit sitting in trust all get reconciled on the statement of adjustments, so your net proceeds will not simply be the sale price minus commission. Ask for a written all-in quote before you retain anyone, and confirm whether disbursements sit inside that number or get billed separately. A low headline fee with unbundled disbursements can finish higher than a flat quote covering everything.
